Discredited Government Witness Causes Rift in Vax Injury Community

Pediatric neurologist and former expert witness Dr. Andrew Zimmerman is being hailed as a whistleblower with the key to resolving thousands of denied vaccine injury cases. In reality, he is an opportunist who hoped to profit off the backs of the vaccine-injured kids he purported to treat by testifying against them in vaccine court. He later realized his submitted opinion was directly contradicted by a petitioner’s case study he had coauthored with her dad. So he broke her confidentiality to the government’s lawyers to cover up the contradiction. Now he is misleading the parents of the very children he helped deny justice to into thinking he holds the secret to getting them that justice. He has convinced them by offering a retrospective diagnosis of a patient he hadn’t seen for years by reviewing his medical records on a flash drive.

Zimmerman’s involvement with the autism omnibus began on April 24, 2007 when he submitted an expert report for the government against the first test case, Michelle Cedillo. In the report he wrote, “there is no scientific basis” for a link between vaccines and autism. He made clear that it was his broad opinion, not just about the specific child whose medical records he reviewed. The report included 17 references, seven he was an author on. Not included in the references was the case study of the child with autism who was also a petitioner for vaccine injury compensation: Hannah Poling. Coauthoring the study with Zimmerman was none other than her father, fellow neurologist Dr. Jon Poling.

Andrew Zimmerman later realized that he had submitted an expert report directly contradicted by his past publication of a petitioner’s case with her parent. So days before his scheduled testimony, Zimmerman alerted the Department of Justice attorneys and broke Hannah Poling’s confidentiality as his patient by pointing them to her case study. He subsequently withdrew as an expert witness and Poling’s case was conceded, preventing the humiliation of a government witness’ acknowledgement of her injury coming out in court. The concession was leaked later and became headline news.

Over the years since then, Zimmerman has been turning the autism community against itself. Immediately after the autism omnibus cases were ruled against, he apparently leaked a letter he submitted about Hannah Poling’s seizures after the concession to omnibus test case parent Rolf Halzehurst. The leak reportedly triggered a near-physical confrontation between the Polings and the Hazlehursts in 2009. Save for a blog comment by Hannah Poling’s mother in 2013 pleading for respect for her daughter’s privacy, the Polings have never spoken out publicly since. Following her plea, a planned congressional hearing based on the confidential information Hazlehurst obtained about Poling from Zimmerman was abruptly cancelled.

Unfortunately, Hazlehurst hasn’t realized he’s being played. Instead he has doubled down to the point of hiring a lawyer to depose Zimmerman two years ago. He did confirm having evaluated Hazlehurst’s son the year after his vaccine reaction only to admit he had no record of a vaccine reaction nor of mitochondrial disorder in medical notes about the child. His diagnosis of a mitochondrial reaction to vaccines was based on his review of records on a flash drive Hazlehurst shared with him earlier in 2016.

Zimmerman also misleadingly stated the Poling case study and his expert witness report were done simultaneously. Yet he submitted his report to the government the year after the study’s publication.

In a sworn affidavit given last September, Zimmerman lied that his expert report to the government was an isolated opinion about one autism case and that the Department of Justice misused it as a general opinion. The report itself was clearly a general opinion, and Zimmerman later acknowledged so in a statement just released through his medical school. In other words, his opinion was used against other cases as he intended including against Hazlehurst’s. So much for Children’s Health Defense’s new cause.

Zimmerman is a liar who violated a patient’s confidentiality to opposition lawyers to prevent his acknowledgement of her vaccine injury from becoming widespread news. When that failed, he apparently shut her parents up by leaking their daughter’s medical information to the parent of another former patient of his. Zimmerman now seems intent on carving out a nice cottage industry of flash drive diagnoses for the very vaccine injury petitioners he denied justice to by turning parents of vaccine-injured children against each other. Their parents are being willfully misled by this charlatan while giving him access to their children’s confidential medical information. Andrew Zimmerman is nothing more than a discredited government witness.
