CHD v. FCC – Litigation Update
Our motions were successful in forcing the FCC to publish in the Federal Register. SUCCESS: The Children’s Health Defense Forced FCC to Publish in the Federal Register, Blocking it from Dismissing Lawsuits. The publication was supposed to block the FCCs ability to dismiss the cases for being premature and to enable us to utilize the multi-jurisdictional panel to get a 50/50 chance of staying in the 9th Circuit. Nevertheless, on 4/25 the 9th issued a decision to transfer us to the DC Circuit without minimal explanation, not addressing the issues raised. We finalized the submissions schedule with EHT, the FCC, and the court. EHT and CHD’s briefs are due on July 1st, 2020.
Take Action Campaigns
Emergency Ordinance to Stop 5G Deployment During Quarantine – CHD’s campaign sent 77,000 letters to municipalities providing a legal mechanism to halt deployment of 5G and processing applications during quarantine.Since the beginning of the Quarantine, we have been receiving an overwhelming number of reports of aggressive expansion of cellular antennas. We provided a legitimate solution that people can push with their municipalities, suggesting that local authorities use their emergency powers to place a moratorium on non-essential activity, including pausing all pending wireless zoning and right-of-way applications, and to shut down new wireless construction. We used CHD’s click to action system. Read more . The campaign created a stir. We know that Municipalities contacted their attorneys and they confirmed that our solution is legit and told them. Some suggested that they refused to process applications without passing an ordinance using the same argument. This was the first LEGAL solution campaign on 5G thus far, sending the message that our side is getting professional with our efforts. We know that this effort also encouraged mayors to stand up to the pressure from Telecom, and municipalities wrote a letter to the FCC not to succumb to industry pressure and not to force the municipalities to process applications during quarantine.
OTARD Campaign – CHD’s Submission to Stop FCC Rule Allowing 5G & Satellites Antennas on Homes – On April 17th, 2020, CHD submitted an Ex-Parte legal notice type letter to stop the FCC from allowing cell towers on homes and launched a campaign enabling people to join us. Over 15,0000 people will be joined to our submission. >The FCC is about to expand its ‘Over The Air Reception Devices’ (OTARD) rule to allow wireless companies to install 5G and other transmitting devices on homes without the need for a permit, without asking for neighbors’ input or permission, or accommodating people with disabilities. The OTARD expansion will allow a “Wireless Wild West” for 5G infrastructure including 1,000,000 antennas to provide the ground infrastructure for the satellites. We wrote an Ex-Parte letter to the FCC stating that the rule will violate the Constitution and common law personal and property rights, and stated that the FCC does not have the authority to pass this rule. The letter aims to establish the legal grounds required if we decide to challenge the regulation if passed. We decided to get the public to join our letter and make a “no consent” statement. We used CHD’s click to action system. This will be one of the largest submissions to the FCC ever. On May 11th, 2020 we closed the registration and are now preparing the submission with the signatures.

The FCC has never assessed the impact of radiation emissions from 50,000 satellites or any other existing and potential adverse environmental effects, yet they continue to approve satellites without any environmental assessment. The FCC Just Approved 6 GHz Frequency Band for Wi-Fi and Why You Shouldn’t Use It – Many readers may not fully appreciate the health risks from Wi-Fi technology. This article about the FCC’s decision from April 23rd to allow the unlicensed use of the 6Ghz band, lays them out. The bad news is that Wi-Fi health risks are going to get worse. The good news is that you can limit them. The impacts of electromagnetic frequencies on the body are complex. While we can test the adverse effects of a specific device or frequency, it is more complex to test the combined impact of numerous frequencies in the environment. Read more.
How to Make Remote Learning Safe for Your Children During COVID-19 Quarantine – As a result of the COVID-19 quarantines across the country, states are promoting the use of wireless devices and wireless access (Wi-Fi and mobile) for children’s remote learning. However, the use of wireless for remote learning is counterproductive for the goal of keeping our children safe and healthy. We encourage parents to wire remote learning devices.

Debate: Bro. Jabari Vs. Attorney Dafna & Curtis Cost: Is 5G Dangerous Or Not? – CHD has been taking action to spread the word about wireless harms in the African American community. Dafna, CHD’s Director of its 5G and Wireless Harms project was invited to take part in a debate in a popular program in the African American community hosted by “SaNeter ” together with Curtis Cost. It was a success: 30,000 views over 1800 comments. According to the comments, Dafna is the winner… 
and was referred to as the White Queen of the Black Community
Viewpoint: Anti-vaccine, anti-GMO groups use coronavirus outbreak to stir unfounded 5G-cancer fears – This article is a representation of media attacks against CHD, using inaccurate accusations. When writing that our claims are “unfounded” they forgot to mention that the WHO classified wireless as a possible carcinogen and that the Federal government’s $25 million NTP study found clear evidence of cancer and DNA damage. It is correct, though, that Children’s Health Defense and Moms Across America “have teamed up in an attempt to block California from expanding 5G wireless access to millions of public school students.” We did it to protect the health of our children as expansive and well founded peer-reviewed science and human evidence clearly show this technology is harmful. We will continue to promote the use of safe technology.

The Lies Must Stop – Disband ICNIRP – In March, for the first time since 1998,The International Commission on Non-Ionizing Radiation Protection (ICNIRP) issued updated guidelines for exposures to RF/microwave radiation. The WHO and many countries around the world are following ICNIRP’s recommendations. But just like the US’s FCC, ICNIRP is captured by the Telecom industry and contrary to clear scientific and human evidence, falsely claims that wireless is safe.

Smartphone Radiation Can Attract Ticks Carrying Dangerous Pathogens If you want to avoid catching a tick, better leave your phone at home when going for a picnic in the park or a run in the woods. The latest Polish-Slovak study shows that ticks, especially carriers of dangerous pathogens, are attracted by electromagnetic radiation at a frequency of 900 MHz. Read more .
