My Letter to Newsom

We’re told everything is going back to “normal,” except for the amount of power held by the Governor.

As it turns out, Gavin Newsom’s refusal to end the State of Emergency is too much for even the New York Times. The paper has a favorable story about my letter to Newsom demanding an explanation.

The letter, which you can read here, is joined by James Gallagher and Melissa Melendez. We explain to Newsom, quite simply, that ending the emergency is not optional:

“Section 8629 of the California Emergency Services Act,” it begins, “provides that the ‘Governor shall proclaim the termination of a state of emergency at the earliest possible date that conditions warrant.’” We continue:

  • Please identify the “conditions of disaster or extreme peril” that are the predicate for the ongoing state of emergency.
  • Last Friday, you stated the state of emergency will remain in effect because “this disease has not been extinguished. It’s not vanished.” Does this mean your intention is to keep the state of emergency in effect until the case rate reaches zero?
  • Please identify the metrics you are using to determine whether the “conditions of disaster or extreme peril” presented by COVID-19 are of such a “magnitude” as to be “beyond the control” of California cities and counties.

As Newsom clings to “emergency” powers, he continues turning them into cash. His anti-Recall fund is raking in huge checks from Hollywood executives who he exempted from his lockdowns.

Meanwhile, yesterday was the deadline to withdraw your Recall signature. A pro-Newsom campaign to get people to recant did have some success in Orange County: 1 signature withdrawn out of 215,000 submitted.

Newsom and his cronies have tried every trick in the book to stop the Recall. But the movement has only grown. Now the people of California can reshuffle the whole stacked deck of our political system.
