tl;dr – Both cases are helpful. Rupp seems to be doing a bit more by attacking the Roberti-Roos list. Rupp case will not have any effect for quite some time because of 9th circuit timelines. Miller case has a chance of something useful happening soon since it’s Judge Benitez and he’s already done something like this twice (Duncan and then Rhode).
